Terms of Service

Provider: The Software Company of Barcelona, S.L. ("KaikuLabs", "we", "us")

1. Acceptance of Terms

By downloading, installing, or using Mochi: Couples Corner ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Who Can Use the App

The App is open to users of all ages. Users under 18 should review these Terms with a parent or guardian. By using the App, you confirm that you have the legal capacity to enter into this agreement, or that a parent or guardian has done so on your behalf.

3. Your Account

You may sign in using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account. You must not share your login credentials with anyone other than your partner within the App's intended use. Notify us immediately if you suspect unauthorized access to your account.

4. Subscriptions

4.1 Subscription required

Mochi: Couples Corner is a paid app. Access to the App's features requires an active subscription. We may offer a free trial period at our discretion; once any trial ends, a subscription is required to continue using the App.

4.2 Billing

Subscriptions are processed through the Apple App Store or Google Play. Billing, renewals, and cancellations are governed by the respective store's terms. We use RevenueCat to manage subscription status.

4.3 Cancellation and refunds

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple or Google in accordance with their respective policies. We do not issue refunds directly.

4.4 Price changes

We reserve the right to change subscription prices. We will give you reasonable advance notice before any price change takes effect.

5. Your Content

You retain ownership of all content you create in the App — journal entries, drawings, mood logs, and countdowns ("Your Content"). By using the App, you grant us a limited, non-exclusive license to store, display, and sync Your Content solely for the purpose of providing the service to you and your partner.

We do not claim any ownership over Your Content and will never use it for advertising or share it with third parties beyond what is described in our Privacy Policy.

6. Shared Content and Partners

Mochi is designed to be shared between two partners. When you connect with a partner, certain content may become visible to them. You are responsible for obtaining your partner's consent before sharing content that relates to them. You can disconnect from a partner at any time through the App settings.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload content that is abusive, harassing, or violates any third party's rights.
• Attempt to reverse-engineer, decompile, or tamper with the App.
• Use the App to send spam or unsolicited messages.
• Circumvent any subscription or access controls.

We reserve the right to suspend or terminate accounts that violate these rules.

8. Intellectual Property

All rights in the App — including its design, code, trademarks, and original content — belong to The Software Company of Barcelona, S.L. or its licensors. These Terms do not grant you any rights in the App other than the limited right to use it as described here.

9. Disclaimers

The App is provided "as is" and "as available". We do not warrant that the App will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by applicable law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by applicable law, KaikuLabs will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law and Disputes

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection laws in your country of residence provide otherwise.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after the effective date constitutes your acceptance of the updated Terms.
